1. Acceptance of Terms

By accessing or using GlamBase ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Service

GlamBase is an AI-powered platform for content creators that provides:

• AI-powered messaging and conversation automation
• Content management and organization (Content Vault)
• Revenue analytics and optimization tools
• Content protection (watermarking, leak detection, DMCA takedowns)
• Cross-platform content distribution
• Subscriber relationship management

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts

When you create an account, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for more than 12 months.

4. Payments & Billing

Paid features of the Service are billed on a subscription basis. By subscribing, you agree to:

• Pay all fees associated with your chosen plan
• Automatic renewal at the end of each billing period unless cancelled
• Price changes with 30 days advance notice

Refund Policy: We offer a 30-day money-back guarantee for new subscriptions. After 30 days, refunds are provided at our discretion. To request a refund, contact [email protected].

Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.

5. Content Ownership

You retain full ownership of all content you upload to GlamBase. By uploading content, you grant us a limited, non-exclusive license to:

• Store, process, and display your content as necessary to provide the Service
• Create derivative works (watermarked versions, thumbnails, remixes) for your use
• Analyze content for AI features (tagging, recommendations)

This license terminates when you delete your content or close your account. We will never use your content for advertising, sell it, or share it with third parties without your explicit consent.

6. AI-Generated Content

Our Service uses AI to generate messages, suggestions, and content variations. Regarding AI-generated content:

• You are responsible for reviewing and approving AI-generated messages before or after they are sent
• AI-generated content is provided "as is" and may not always be accurate or appropriate
• You retain ownership of AI-generated content created using your data and style
• Your data is used only to train your personal AI model, never shared models

GlamBase is not liable for any consequences arising from AI-generated messages sent on your behalf, whether in autopilot or approval mode.

7. Acceptable Use

You agree not to use the Service to:

• Upload or distribute content involving minors
• Engage in harassment, abuse, or threatening behavior
• Upload content you do not have the right to distribute
• Attempt to circumvent security measures or access other users' data
• Use the Service for illegal activities
• Distribute malware or harmful code
• Impersonate others or misrepresent your identity
• Scrape, mine, or extract data from the Service

Violation of these terms may result in immediate account termination without refund.

8. Intellectual Property

The Service and its original content (excluding user-uploaded content), features, and functionality are owned by GlamBase Inc. and are protected by international copyright, trademark, and other intellectual property laws.

Our trademarks, service marks, and logos may not be used without our prior written consent. You are granted a limited, non-transferable license to use the Service for its intended purpose.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLAMBASE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of revenue, profits, or data
• Content leaks or unauthorized distribution despite protective measures
• AI messaging errors or inappropriate responses
• Service interruptions or downtime
• Failure of DMCA takedown requests

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless GlamBase, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Content you upload or distribute through the Service
• AI-generated messages sent on your behalf
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for:

• Breach of these Terms
• Violation of our Acceptable Use policy
• Non-payment of fees
• At our discretion, with 30 days notice for any reason

Upon termination, your right to use the Service ceases immediately. Your data will be retained for 30 days to allow for export, then permanently deleted.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.

You agree to waive any right to a jury trial or to participate in a class action lawsuit against GlamBase.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through:

• Email notification to registered users
• Prominent notice within the Service
• Updated "Effective Date" at the top of this page

Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service.
